Social Security will pay welfare benefits to recipients to new skill

The Federal Court judge Canoes, William Pine Machado, determined in preliminary injunction, which the National Social Security Institute (INSS) continue to be paid to recipients of the 41 cities covered by Executive Management Canoes (GEC), the benefit for state disease until the completion of new expertise. The INSS has 30 days to comply with the measure, failing to pay a daily fine of R $ 1mil per insured.

The Public Defender of the Union (DPU) applied through the Public Civil Action No. 5000039-15.2010.404.7112 , automatic extension of all the benefits of sickness of the insured, linked to the GEC, which carried out the request to extend the benefit , to be submitted to the medical expertise of the INSS office. The DPU reported that after receiving the aid, sick workers had their high pre-programmed by the municipality. However, due to lack of experts, new exams were rescheduled for a period of 4 to 6 months after discharge planned, while the insured must request 15 days before the end of the benefit, the extension thereof. Thus, the citizens who need new skills would not receive any remuneration.

The magistrate said that "the worker and the employer deducts the monthly installment to pay Social Security, which has the obligation to pay benefits on time, which almost always are the only source of income of the insured, even when sick and unable to to work. " With the Federal Court decision, while the insured is not subject to a new skill, in which to experience the healing of fact, Social Security must continue to pay sick pay.
